Texas is considered one of the biggest untapped gambling markets in the US. However, its strict gambling landscape is still in the way. Most forms of gambling are illegal in Texas, but despite these limitations, sweepstakes casinos still operate in the state legally. The other legal forms of gambling are lottery, gambling at tribal casinos, horse and greyhound racing, and charitable bingos.

Since real-money online gambling is not allowed, many Texans look for options that offer classic casino games without breaking the rules; a kind of system that uses a promotional system instead of direct cash betting. This is exactly what sweepstakes are about. They use two types of currency: virtual coins and sweepstakes entries. This is why the sweepstakes option has become the best alternative to classic casinos for Texas gamers. The model lets players enjoy slots, table games, and other games while staying within Texas law. 

Such casinos operate in the legal grey zone, as there is no direct rule allowing or banning them from operating. There is also little to no enforcement from the state agencies to police these casinos. To avoid breaching any gambling laws, sweepstake casinos position themselves as promotional giveaways instead of gambling businesses, and they try to avoid the three requirements of gambling set by the Texas Legislature: consideration, prize, and chance. 

While critics argue that the concept of chance affects the outcome of sweepstakes games, operators have explained that these games are determined by promotional rules and not chance. Regardless of the debate, many Texans visit these sweepstakes platforms as they are the only gambling options available. 

As the debate on sweepstakes casinos continues, experts believe that lawmakers will soon develop new regulations. In May, the Texas Senate advanced SB517, which targeted “eight-liner” machines and illegal game rooms. Although the bill didn’t directly address sweepstakes casinos, it had new definitions for ‘gambling devices’ and ‘a thing of value,’ which are phrases that apply to the sweepstakes industry. 

The term ‘gambling devices” refers to any devices that a player uses for gambling activities, while ‘thing of value’ could refer to money or virtual currency, which many sweepstakes casinos use for gambling. With the bill heading to the House for more review, sweepstakes operators are hoping that lawmakers can clearly define these terms and how they would affect their operations. 

Texas lawmakers aren’t the only ones taking action on the sweepstakes industry. Michigan redefined internet gambling, which eventually made sweepstakes casinos illegal in the state. Other states like Connecticut, Nevada, and New Jersey have taken a firm stance against sweepstakes casinos, passing bills to outlaw them. California recently joined the list in October when its governor signed AB831 into law. With more states calling for tighter laws, Texas’s sweepstakes industry may be walking a thin line. For now, sweepstakes casinos are still allowed in the state and serve as an option to anyone looking to play at regular casinos.

Apart from the attempt to crack down on sweepstakes casinos, Texas’s gambling industry suffered another defeat as its push to legalize gambling was turned down by Governor Greg Abbott. Gov. Abbott explained that he wasn’t ready to change Texas’s laws on casino gambling because of the welfare of its citizens. 

Despite this refusal, stakeholders in the gambling industry aren’t giving up and plan to return with an improved bid in the coming months. For now, legalized gambling is still a headache in Texas, and stakeholders would need approval from the Texas House and Senate before meeting Gov. Abbott again.
